1. INTRODUCTION

1.1. General Terms

Thank you for choosing us. Before getting started, please carefully read these General Terms of Service (“General Terms”). These General Terms govern your use of and access to the ExplorerVPN service and any future software or services that may be provided by MB Baltic Shield (collectively referred to as the “Service” or “Services”). These General Terms also apply to the use of and access to ExplorerVPN’s websites (“Websites”).

1.2. Subscription

All our paid Services are provided on a subscription basis. This means that your subscription will automatically renew at the end of each billing cycle unless you cancel it before the renewal date.

1.3. Terms

These General Terms and any applicable service-specific terms (see Section 2 below), collectively constitute the “Terms”.

1.4. ExplorerVPN

For the purpose of these Terms, “ExplorerVPN”, “we”, “us”, or “our” means MB Baltic Shield, Asigalio g. 45–5, Kaunas, 49146, Lithuania.

1.5. Privacy

For information about how we collect and process your personal data, please refer to our Privacy Policy.

2. YOUR AGREEMENT WITH EXPLORERVPN

2.1. Binding Legal Agreement

These Terms constitute a binding legal agreement between you (or the entity you legally represent) (“you”) and ExplorerVPN (operated by MB Baltic Shield). You agree to be bound by these Terms by any of the following actions:
(i) creating a user account and/or other accounts to use the Services (“Account”);
(ii) downloading software or accessing/using the Services and Websites; or
(iii) otherwise electronically agreeing to be bound by these Terms.

If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to act on behalf of that organization and to bind it to these Terms.

OUR SERVICES ARE OFFERED TO YOU CONDITIONALLY ON YOUR ACCEPTANCE OF THESE TERMS. PLEASE READ THEM CAREFULLY. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS OR ANY PART THEREOF, PLEASE DO NOT ACCESS OR USE OUR SERVICES AND/OR WEBSITES.

2.2. Service-Specific Terms

Some of our Services may have additional terms and conditions. Your use of the following products is subject to both these General Terms and their respective Service-Specific Terms (“Service-Specific Terms”):

By using the Services, you also agree to the applicable Service-Specific Terms. If there is any conflict between these General Terms and the Service-Specific Terms, the latter shall prevail with respect to the specific Service.

2.3. Services

Our Services are generally provided on a paid subscription basis. However, we may also offer a version of certain Services that is free of charge. These Terms apply to both free and paid versions of our Services.

2.4. Accessing the Services and/or Websites

By accessing or using the Services and/or Websites, you affirm that you are at least eighteen (18) years old or have legal authority to act on behalf of a valid legal entity. You further affirm that you have the legal capacity and all necessary rights to enter into this binding agreement and to comply with its terms.

2.5. Updates to the Terms

We continuously improve our Services and Websites, which may involve adding new features or modifying existing ones. Accordingly, we may update these Terms from time to time in order to:
(i) comply with applicable laws or regulations;
(ii) implement orders or recommendations of regulatory authorities;
(iii) introduce or remove functionalities, services, features, technologies, or benefits;
(iv) fix errors or bugs;
(v) clarify existing provisions;
(vi) prevent abuse or harm;
(vii) or for any other valid reason (e.g., for security purposes).

You acknowledge and agree that it is your responsibility to periodically review the Terms to stay informed of the current terms and obligations. If any material changes are made that affect your rights or obligations, we will notify you in advance by reasonable means (e.g., via email or through the Services). Unless otherwise stated, updates become effective upon publication. Your continued use of the Services constitutes your acceptance of the revised Terms.

You may terminate your relationship with us at any time after the effective date of the updated Terms by closing your Account and ceasing to use our Services and Websites.

3. SUBSCRIPTION AND AUTO-RENEWALS

3.1. Subscription. All our paid Services are provided on a Subscription basis. You choose the period of Services and the payment method yourself when you purchase the Services.

3.2. Auto-Renewal. After the end of your Service period, your Subscription will automatically renew for the successive defined Service periods at the renewal dates, unless you decide to cancel the Subscription renewal before the day of the charge. If you do not cancel the Subscription in such due course, your chosen payment method will be charged the then-current renewal price for the upcoming defined Service period.

4. YOUR USER ACCOUNT

4.1. Creating an Account. To access and use any of our Services, you must create an Account by providing certain information (such as your email address, password, billing details, and country of residence). All information you provide must be complete, accurate, truthful, and kept up to date at all times. All ExplorerVPN Accounts are non-transferable.

4.2. Confidentiality of and Access to the Account. You agree that you are solely responsible for any and all usage and activities that occur under your Account or password, including but not limited to use by any third party, whether authorized by you or not. You are responsible for maintaining the confidentiality of your Account credentials and for restricting access to your Account.

To help protect your Account:

  • Keep your password secure and confidential.
  • Do not reuse your ExplorerVPN password across other services.
  • Notify us immediately if you become aware of any unauthorized use of your Account or password.

5. PRICES AND PAYMENTS

5.1. Total Price.

Prices for our Services may be initially displayed exclusive of applicable taxes. Due to the global nature of our Services and the mobility of users, we might not always be able to determine the applicable taxes in advance. Therefore, mandatory taxes (e.g., sales tax, value-added tax, or other taxes as per your local laws) will be calculated after you select your tax residence country. In all cases, the total price, including applicable taxes, will be clearly shown before payment is charged.

5.2. Payments

You agree to pay for any paid Services you purchase from us, along with all applicable taxes and fees incurred under your Account. Failure to pay on time may result in suspension or cancellation of your Services, and may lead to loss of access to your Account or its content.

5.3. Recurring Payments

If you purchase Services on a subscription basis (e.g., monthly, annually), you agree that:
(i) the subscription will auto-renew unless canceled prior to the next billing cycle;
(ii) you authorize recurring payments;
(iii) charges will be made by us or a designated [Payment provider] using the selected payment method and billing frequency;
(iv) we may, where applicable, receive and use updated card information from your card issuer or network to process renewals.

5.4. Payment Methods

To purchase Services directly through our Website, you must provide a valid and up-to-date payment method, such as a credit or debit card, or any other payment option available through our [Payment provider].

5.5. Billing

By submitting your payment information, you (i) confirm that you are authorized to use the selected payment method;
(ii) authorize us and/or our [Payment provider] to charge the selected payment method for the purchased Services;
(iii) agree that recurring charges may be processed for subscription renewals.

You can access your billing history and generate receipts/invoices in your Account dashboard or receive them by email.

5.6. Payment Providers

Your purchase may be processed by one or more [Payment provider] entities depending on your country or selected payment method. For more information on how your personal data is processed during payments, please refer to our Privacy Policy.

5.7. Payment Processing

We reserve the right to:
(i) use updated card information obtained electronically from card networks (where applicable);
(ii) retry failed payments;
(iii) change or replace Payment providers to ensure uninterrupted service and processing.

5.8. Fraud Protection

We reserve the right to verify credit or debit card payments prior to completing your purchase as part of our fraud prevention measures.

5.9. Change of Prices

We may, at our reasonable discretion, update the prices of our Services, including subscription renewal prices, to reflect cost changes related to licensing, infrastructure, support, administration, third-party services, taxes, and other business factors. Any price changes will not affect your current billing period and will only apply to the next renewal. You will be notified in advance of any price changes.
Subject to applicable law:
(i) if you do not agree with the new price, your sole remedy is to cancel your subscription before the next charge;
(ii) continued use of our Services constitutes agreement to the new price.

5.10. Changes of Payment Details

If your payment details change (e.g., card number or expiration date), please update your Account information promptly to avoid disruption. In some cases, updated payment information may be provided automatically by your bank or payment network, and we may use it to update your account accordingly.

5.11. Free Trials

From time to time, we or our partners may offer a free trial of our paid Services. The duration, terms of use, and scope of the free trial will be clearly indicated during the sign-up process or in promotional materials.

Eligibility for free trials is determined solely by us. We reserve the right to limit or revoke free trial offers at any time. If you sign up for a subscription during a free trial, your payment method will be automatically charged at the end of the trial period unless you cancel before it ends.

If you received your free trial through a third party, cancellation must be done through that third party.

We reserve the right to limit one free trial or promotion per user and to prohibit combining multiple offers.

6. CANCELLATION AND REFUND POLICY

6.1. Subscription Cancellation

You have the right to cancel your Subscription (i.e., turn off auto-renewal for the upcoming Service period) at any time. Please note that canceled Subscriptions will not be refunded for the unused portion of the current billing period. Your ability to cancel and/or request a refund may vary depending on whether the Service was purchased directly through ExplorerVPN or via a third party (e.g., app store, service provider, or reseller).

6.2. Refund – Money Back Guarantee

We want you to be fully satisfied with our Services. If you are not satisfied, you may cancel your Subscription and request a refund within thirty (30) days from the date of your initial purchase (“Money Back Guarantee”). This guarantee applies only to the first purchase of a Subscription. Renewals are not eligible for a refund under the Money Back Guarantee, unless otherwise required by applicable law (see “Pro Rata Refund” below).

Please note: we reserve the right not to issue a refund under the Money Back Guarantee if there has been a violation of Section 8 of the General Terms (“Prohibited and Restricted Use”). We are happy to attempt to resolve any issues before a refund is requested.

6.3. Pro Rata Refund

If you are a resident of Germany, the Netherlands, or the United Kingdom, and your Subscription (longer than one month) was renewed after March 1, 2022, you are eligible for:

  • a full refund if the request is made within 30 days of renewal; or
  • a partial (pro rata) refund for the remaining months in your renewed Subscription, calculated from the following month after your refund request.

6.4. Payment of Refund

Refunds will be processed without undue delay and will be issued using the same payment method used for the original transaction, unless otherwise agreed or restricted by law or technical limitations.

  • Cryptocurrency payments will be refunded in the same cryptocurrency and to the same wallet address from which the payment was received. If the original currency becomes unavailable or impractical, an alternative cryptocurrency may be used.
  • Prepaid cards or gift cards will not be refunded unless supported by the card provider.
  • Once a refund is issued, access to the corresponding Services will be revoked.

6.5. Eligibility for Refund

You are eligible for a refund only once under the Money Back Guarantee. If you purchase the same Service again after receiving a refund, you will not be entitled to another refund for subsequent cancellations. If you cancel your Subscription after the 30-day Money Back Guarantee period has expired, you will continue to have access until the end of the billing cycle, but no refund will be provided.

Please note that our refund process is automated for speed and efficiency. However, if you believe the automated decision was incorrect and you are entitled to a refund under applicable law, please contact our support team at support@explorervpn.com and we will review your case manually.

6..6 Subscriptions Purchased via Apple App Store

Subscriptions purchased through the Apple App Store are subject to Apple’s own refund policy. ExplorerVPN is not able to process refunds for these purchases. Please refer to Apple’s in-app purchase refund policy or contact Apple Support. To cancel auto-renewal for such subscriptions, please do so directly via your Apple ID account settings.

6.7. Subscriptions Purchased via Other Providers

Refunds for purchases made via third-party providers (e.g., Google Play, Amazon, StackSocial, etc.) are subject to those providers’ respective terms of service and refund policies. Subscription cancellation in such cases must also be handled through the provider.

6.8. Canceling Auto-Renewal for Subscriptions Purchased on Our Website

If you purchased your Subscription directly through the ExplorerVPN website, you can turn off auto-renewal at any time via your Account settings. Please note that canceling auto-renewal will stop the next charge, but the unused portion of the ongoing Service period is non-refundable.

7. LICENSE TERMS

7.1. Software

To access and use our Services, you may be required to download and install our Software on a compatible device. In these Terms, “Software” refers to any mobile or desktop applications, other downloadable components, updates, enhancements, revisions, and documentation that we provide in connection with the Services.

7.2. License Grant

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, personal, non-transferable, non-sublicensable, non-assignable, fixed-term license (“License”) to download, install, and use one copy of the Software on a compatible device that you own or control. No other rights or licenses are granted to you in relation to the Software or Services, either express or implied.

7.3. Apple Requirements

If you download the Software from Apple Inc.’s App Store, this License is limited to use on Apple-branded devices that you own or control, and only as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions. Family Sharing and volume purchasing features may apply, where applicable.

7.4. We Retain All Rights

The Software is licensed, not sold. These Terms do not grant you any title or ownership rights to the Software, Services, or Websites. All rights, title, and interest in and to the Services, Software, and Websites remain exclusively with us and/or our licensors. All rights not explicitly granted to you under these Terms are reserved.

ExplorerVPN and related names, logos, and symbols are protected trademarks of MB Baltic Shield. You are strictly prohibited from copying, using, registering, or imitating any trademarks, trade names, domain names, icons, or visual identities that are identical or confusingly similar to those belonging to ExplorerVPN.

7.5. The version of the Services and Software available to you at the time of renewal may differ from the version originally purchased. We provide software updates for supported operating systems for a minimum of two (2) years from the original OS release date.

7.6 Feedback

You hereby grant us a perpetual, irrevocable, worldwide, royalty-free license to use any Feedback (as defined below) you provide to us, without obligation, attribution, or compensation. You waive all rights (including moral rights) to such Feedback.

“Feedback” means any suggestion, idea, proposal, recommendation, review, or input related to the Services, Software, or Websites, whether submitted directly or indirectly.

8. PROHIBITED AND RESTRICTED USE

8.1. Your access to and use of the Services and Websites is subject to these Terms and all applicable laws and regulations. We reserve the right, at any time and at our sole discretion, with or without notice, to suspend or terminate your Account and/or access to the Services if you violate applicable laws or these Terms—whether it is a repeated violation or a single serious incident. Please also refer to Section 12 of these Terms (“Suspension and Termination”).

8.2. You agree not to, and not to enable or assist others to:

  • Use the Services/Websites for any unlawful, illicit, criminal, or fraudulent activities, including but not limited to: port scanning, spam, phishing, pharming, cloaking, credit card or cryptocurrency fraud, hacking, identity theft, scraping, digital piracy, DDoS attacks, child exploitation, blackmail, or sale of stolen or controlled goods.
  • Use the Services/Websites for any military purposes, including cyber warfare, development or deployment of weapons, or weapons of mass destruction.
  • Interfere with, disrupt, or gain unauthorized access to any network, computer, or system using our Services.
  • Exploit, harm, or endanger children in any form, including visual, audio, or digital content.
  • Infringe upon any intellectual property rights, privacy, or other legal rights of ExplorerVPN, its licensors, or any third party.
  • Communicate or store any content that is illegal, abusive, harassing, or otherwise objectionable, including anything that would reasonably be deemed offensive, dangerous, or inappropriate by ExplorerVPN or its users.
  • Transmit malicious code (e.g., viruses, spyware, or any other code intended to disrupt or damage systems).
  • Attempt to circumvent or disable any security or access controls.
  • Disrupt the performance or integrity of the Services/Websites.
  • Impose an unreasonable or excessive load on our infrastructure.
  • Sublicense, resell, assign, or otherwise commercially exploit the Services, Subscriptions, or Accounts without our express permission.
  • Use bots, spiders, scrapers, or other automated systems to access our Services/Websites without permission.
  • Copy or build competing products using any ideas, features, or components of the Services/Websites.
  • Misrepresent yourself as an agent or representative of ExplorerVPN.
  • Harass, threaten, or discriminate against others.
  • Attempt unauthorized access to other users’ accounts, systems, or data through hacking or brute-force methods.
  • Violate ethical norms, good customs, or fair conduct expectations.
  • Use the Services/Websites for any purpose other than lawful and authorized ones.
  • Demonstrate disrespectful, offensive, or malicious behavior when communicating with ExplorerVPN customer support or personnel.
  • Access or use the Services if you have been previously banned or your Account has been suspended.
  • Share or leak any non-public features or content of the Software/Services with third parties.
  • Violate or attempt to circumvent any provision of these Terms.

8.3. In addition, you may not:

  • Reproduce, distribute, modify, display, reverse-engineer, decompile, decrypt, or otherwise tamper with the Software, Services, or Websites;
  • Create derivative works from or translate/adapt the Software or its outputs;
  • Lease, sublicense, or rent access to the Services;
  • Remove proprietary rights notices or trademark indicators;
  • Attempt to derive source code or confidential data, except where explicitly permitted by applicable law.

8.4. We use monitoring tools to identify and prevent prohibited activities, such as web scraping or abusive behavior. Repeated or severe violations may lead to immediate Account suspension.

8.5. You are solely responsible for understanding and complying with all laws and regulations applicable to your jurisdiction, and any region through or with which you communicate using our Services.

8.6. If you believe someone is violating these Terms, we encourage you to report it by contacting us as described in Section 18 (“Contact Us”). We reserve the right to take any appropriate action in response.

9. DISCLAIMER OF WARRANTIES

9.1. We make reasonable efforts to improve the reliability, security, and integrity of the Services; however, complex software is never entirely free from defects, errors, or bugs. We do not warrant that the Services will be free from issues such as downtime, loss or corruption of data, delays, outdated information, or other faults.

Notwithstanding any provision of these Terms, we reserve the right to modify, suspend, or discontinue access to the Services—or any of their features—at any time and without liability, to the extent permitted by applicable law.

On rare occasions, the Services may become unavailable due to technical failures (including but not limited to human error, system overload, software bugs, telecommunication failures, or mechanical breakdowns). We cannot predict or control when such issues might occur, nor can we guarantee the duration of any disruption.

9.2. THE SERVICES AND WEBSITES ARE PROVIDED “AS IS” AND “WITH ALL FAULTS”. WE MAKE NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE COMPLETENESS, ACCURACY, FUNCTIONALITY, SUITABILITY, OR AVAILABILITY OF THE SERVICES.

You acknowledge that we cannot control how you use the Services, and we do not guarantee any particular results or performance from your use. You accept full responsibility for any risk, error, or data loss that may result from your use of the Services.

To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, including but not limited to:

  • Implied warranties of merchantability,
  • Fitness for a particular purpose,
  • Non-infringement,
  • Warranties arising by course of dealing or usage of trade.

Without limiting the above, we make no representation or warranty that:

  • Your use of the Services will not infringe the rights of third parties;
  • The Services will be continuously available or uninterrupted;
  • The Services will be error-free or meet your expectations.

Please note that some jurisdictions do not allow the exclusion of certain implied warranties, so some disclaimers above may not apply to you. You may also have additional rights under local law that vary depending on jurisdiction.

10. LIMITATION OF LIABILITIES

10.1 There are inherent risks associated with accessing, transmitting, and using any data or content on the internet. By using the Services, you acknowledge and accept these risks. ExplorerVPN disclaims any responsibility for the behavior of its users and/or visitors while using the Services or Websites.

10.2. YOUR USE OF THE SERVICES AND WEBSITES IS AT YOUR OWN RISK. NEITHER EXPLORERVPN, NOR ITS OWNERS, EMPLOYEES, OFFICERS, DIRECTORS, PARTNERS, CONTRACTORS, OR AFFILIATES SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data or information of any kind,
  • Loss of business or revenue,
  • Lost profits,
  • Business interruption,
  • Costs of substitute services,
  • Damage to devices, software, or networks,
  • Any other commercial or personal losses.

This applies whether the claim is based in contract, tort, strict liability, or otherwise—even if ExplorerVPN has been advised of the possibility of such damages.

10.3. In any case, to the maximum extent permitted by law, the total aggregate liability of ExplorerVPN for any claims arising out of or relating to these Terms shall not exceed the total amount paid by you to ExplorerVPN for the Services in the twelve (12) months immediately preceding the event giving rise to the liability. This limitation applies regardless of the nature or cause of the claim and excludes any reimbursement for attorney fees or court costs.

You acknowledge that the pricing of the Services reflects this allocation of risk, and that ExplorerVPN would not provide the Services without these liability limitations.

10.4. Some jurisdictions do not allow the exclusion or limitation of liability for certain damages (e.g., death or personal injury caused by negligence, fraud, or gross misconduct). In such cases, the limitation of liability described here shall apply only to the extent permitted by applicable law.

10.5. Please also note that, although ExplorerVPN has implemented reasonable security measures to protect the Services and Websites, the internet is not inherently secure. We cannot guarantee uninterrupted access, complete protection from cyberattacks or data breaches, or the performance of transmissions across the internet. You are solely responsible for taking adequate precautions to protect your data, devices, and systems from malware, viruses, or other internet-based threats.

11. INDEMNIFICATION

11.1. You agree to indemnify, defend, and hold harmless ExplorerVPN, its owners, directors, employees, agents, contractors, partners, and affiliates from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable attorney fees and expert witness fees) that arise out of or relate to:

  1. Your breach of these Terms;
  2. Your use of the Services (or use by anyone accessing the Services through your Account);
  3. Your violation of any applicable laws, rules, or regulations;
  4. Your negligence, misconduct, or intentional wrongdoing.

This obligation includes covering any resulting judgments, settlements, fines, or fees.

11.2. ExplorerVPN shall not be liable for any delay or disruption in your access to or use of the Services resulting from the actions covered under this Section, including any indirect damages arising from such disruption.

12. SUSPENSION AND TERMINATION

12.1. Suspension and Termination by ExplorerVPN

We may suspend (e.g., for investigation or clarification) or terminate your Account and/or access to the Services, without prior notice if:

  • (i) we are unable to charge you for your auto-renewed Subscription,
  • (ii) you breach Section 8 of these Terms ("Prohibited and Restricted Use"),
  • (iii) you violate any applicable laws or regulations,
  • (iv) we are legally required to do so by a court or competent authority (e.g., when providing the Services becomes unlawful in your jurisdiction).

Whenever possible, we will give you a reasonable opportunity to correct the issue before proceeding with suspension or termination. If your Account is suspended, you will need to contact us for further information and clarification. We may—but are not obligated to—keep the suspension temporary before deciding on permanent termination.

In general, we will send you prior notice before suspending or terminating your Account and/or Services. However, in the following situations we may not be able to notify you in advance:

  • (i) if you are in material breach of Section 8 or relevant laws in a way that seriously endangers us, other users, or disrupts the Services;
  • (ii) if your contact information is missing, invalid, or outdated;
  • (iii) if legal or regulatory obligations prevent us from sending a notice.

Any suspension or termination applies personally to you. You are not allowed to access the Services using another Account you own or through Accounts created by others.

12.2. Termination by You

You may terminate the Services at any time as outlined in Section 6 (“Cancellation and Refund Policy”). For information on how to delete your Account, please refer to our Privacy Policy.

12.3. Effects of Suspension or Termination

Upon suspension or termination, you will immediately lose access to the Services and must cease using the Software. Any License granted under Section 7.1 or elsewhere in these Terms will also be automatically and immediately terminated without further notice. You must delete, destroy, or return all copies of the Software in your possession or control.

12.4. Survival of Terms

Sections 7 through 16 of these Terms, as well as any other provisions that by their nature are intended to survive termination or expiration, shall remain in full force and effect even after your access to the Services is terminated.

13. APPLICATION PLATFORM TERMS

13.1. Apple App Store

If you downloaded our Software from the Apple App Store or are using the Software and Services on any Apple-branded device, you acknowledge and agree to the following:

These Terms are between you and ExplorerVPN, not with Apple. Apple is not responsible for the Services, Software, or their content. For any questions or support needs, please contact ExplorerVPN, not Apple, as Apple is not obligated to provide maintenance or support for the Services.

If the Software fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if applicable. To the maximum extent permitted by law, Apple has no further warranty obligations regarding the Software.

Apple is not responsible for:

  • (i) product liability claims,
  • (ii) compliance with legal or regulatory requirements,
  • (iii) claims under consumer protection or similar laws.

Apple is also not responsible for resolving intellectual property infringement claims related to your use of the Services.

You agree to comply with all applicable third-party terms when using the Services.

Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple shall have the right (and will be deemed to have accepted the right) to enforce these Terms against you.

You further represent and warrant that:

  • (i) you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country,
  • (ii) you are not listed on any U.S. Government restricted parties list.

13.2. Other Stores

If you download our Software from any other store, platform, or marketplace (such as Google Play, Amazon Appstore, Microsoft Store, HUAWEI AppGallery, or others), you acknowledge and agree to the applicable customer terms of use for those stores.

ExplorerVPN is the licensor of the Software and the provider of the Services. Any such store, platform, or marketplace provider is not a party to these Terms.

14. BUNDLED SUBSCRIPTIONS AND THIRD PARTY SERVICES

14.1. Bundled Subscriptions

You may purchase a Subscription to ExplorerVPN Services bundled with other ExplorerVPN Services and/or with subscriptions to Third Party Services (“Bundled Subscriptions”).

14.2. Third Party Services Acquired through ExplorerVPN

We may offer you the ability to acquire third-party products and/or services (either as standalone services or together with ExplorerVPN Services) for a fee or free of charge as part of a Bundled Subscription (“Third Party Services”).

In such cases:

  • Your billing relationship remains with ExplorerVPN.
  • Any charges will be billed by us using the payment method you provided.
  • These Third Party Services are governed not only by our Terms, but also by the respective third party’s terms of use, which you accept by acquiring or activating such services through us.

Please carefully review all applicable third-party terms and policies before activating or using Third Party Services. You may also be required to follow additional steps, such as creating a separate user account with the third party, to begin using the service.

In the event of a conflict between the third party’s terms and these Terms—particularly with regard to Subscription management, auto-renewals, pricing, or refunds—these Terms shall prevail with respect to the relationship between you and ExplorerVPN.

14.3. Cancellation of Bundled Subscriptions and Third Party Services

You may cancel your Bundled Subscription or Third Party Services (i.e., disable auto-renewal for the upcoming billing period) at any time.

Please note that:

  • Cancelling a Bundled Subscription automatically ends your access to all included services.
  • Partial cancellations (i.e., cancelling one service within a bundle while retaining the others) are not supported.

14.4. ExplorerVPN Services Purchased Through Third Parties

In some cases, you may acquire ExplorerVPN Services as part of a bundled offer provided by a third party (e.g., through a retailer, app store, or platform integration).

We are not responsible for such bundled offers or their terms. Please ensure you review all applicable third-party terms and conditions before making a purchase via third-party channels.

15. GOVERNING LAW AND DISPUTE RESOLUTION

15.1. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Lithuania, excluding its conflict of law rules.

However, if you reside in a country that requires consumer contracts to be governed by the mandatory legal provisions of your country of residence (such as in the European Union), then those mandatory provisions shall apply to the extent required by law.

15.2. Out-of-Court Resolution of Disputes

We always aim to resolve issues in a fair and amicable way without resorting to formal legal action. If you have a dispute or concern regarding the Services, please contact us first at disputes@explorervpn.com with a written notice describing:

  • Your full name,
  • A detailed description of the issue,
  • The resolution you are seeking.

We will do our best to resolve the dispute informally by replying to your inquiry in a timely and constructive manner. If the dispute is not resolved informally, either party may initiate formal legal proceedings.

15.3. Judicial Resolution of Disputes

You and ExplorerVPN agree that any legal action or proceeding arising from these Terms shall be brought before the courts of the Republic of Lithuania, unless otherwise required by mandatory consumer protection laws in your country of residence (e.g., if you live in the European Union, you may have the right to bring disputes before courts in your own country).

15.4. Online Dispute Resolution in the EU

If you are a consumer residing in the European Economic Area or Switzerland, you may submit your dispute to an EU-recognized consumer dispute resolution body in accordance with local regulations and procedures.

16. CLASS ACTION WAIVER

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

16.1. Where permitted under applicable law, **you and ExplorerVPN agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative action.

Unless both you and ExplorerVPN expressly agree otherwise in writing, no arbitrator or judge shall consolidate more than one person's claims or preside over any form of a class, collective, or representative proceeding.

17. MISCELLANEOUS

17.1. Availability of Services

Actual coverage, speed, availability, and quality of Services may vary depending on technical and environmental factors. ExplorerVPN continually works to improve its Services, but Services may be temporarily unavailable due to:

  • (i) updates, testing, or regulatory changes;
  • (ii) maintenance, outages, or unforeseen technical issues;
  • (iii) force majeure events or factors beyond our control.

17.2. Modification and Termination of Services

We reserve the right to modify, suspend, or discontinue any part of the Services at any time without liability. If we permanently discontinue a paid Subscription before its term ends, we will issue a pro-rata refund for the unused portion—provided your billing details are up to date and none of the exceptions listed in Section 12.1 apply.

We are not liable for interruptions or failures caused by internet providers, government action, third parties, or external events.

17.3. Severability

If any part of these Terms is found unenforceable or invalid, the remainder shall remain in full force and effect.

17.4. Assignment

You may not assign these Terms or your rights without ExplorerVPN's prior written consent. We may assign or delegate our obligations without notice in connection with, for example, corporate restructuring, sale, or merger.

17.5. Data Charges

You are responsible for any data usage charges, roaming fees, or text messaging costs incurred while using the Services.

17.6. Third-Party Components

Our Services and Software may include third-party components or integrate with external services. The disclaimers and limitations under Sections 9 and 10 apply to such use. When interacting with third-party services (e.g., social media, app stores), review their own terms and policies.

17.7. Linking to Our Website

You may link to our Website fairly and legally, provided that such linking does not imply affiliation, approval, or endorsement by us.

17.8. Communication with ExplorerVPN

You agree to receive communications from us electronically (via email, website, apps, or support channels) and acknowledge such communication holds the same legal weight as paper communication. You must keep your contact information up to date.

17.9. Internet Connection

Some Services require a stable internet connection, which is your responsibility to maintain.

17.10. Export Laws

ExplorerVPN Services may be subject to export control laws and sanctions, including those of the U.S., European Union, and United Kingdom. You represent that you are not located in or affiliated with any sanctioned or embargoed country or listed person, and you agree not to export or re-export the Services in violation of any applicable laws or sanctions.

17.11. Exclusions

Some jurisdictions may not allow certain exclusions or limitations of liability. In such cases, relevant legal protections may still apply to you.

17.12. Prevailing Language

These Terms are originally drafted in English. In case of any conflict between translated versions and the English version, the English version shall prevail.

17.13. Force Majeure

ExplorerVPN shall not be held liable for delay or failure to perform due to causes beyond our reasonable control, including but not limited to natural disasters, war, civil unrest, regulatory action, strikes, cyberattacks, software bugs, infrastructure failure, or acts of God.

17.14. No Reliance

You agree that you have not relied on any statements, promises, or representations that are not expressly stated in these Terms.
